  26. CREATIVE COMMONS PUBLIC LICENSE ("CCPL" OR "LICENSE"). THE WORK IS
  27. PROTECTED BY COPYRIGHT AND/OR OTHER APPLICABLE LAW. ANY USE OF THE
  28. WORK OTHER THAN AS AUTHORIZED UNDER THIS LICENSE OR COPYRIGHT LAW
  29. IS PROHIBITED.
  30. BY EXERCISING ANY RIGHTS TO THE WORK PROVIDED HERE, YOU ACCEPT AND

  35. 1. Definitions
  36. a. "Adaptation" means a work based upon the Work, or upon the
  37. Work and other pre-existing works, such as a translation,
  38. adaptation, derivative work, arrangement of music or other

  40. performance and includes cinematographic adaptations or any
  41. other form in which the Work may be recast, transformed, or
  42. adapted including in any form recognizably derived from the
  43. original, except that a work that constitutes a Collection
  44. will not be considered an Adaptation for the purpose of this
  45. License. For the avoidance of doubt, where the Work is a
  46. musical work, performance or phonogram, the synchronization of
  47. the Work in timed-relation with a moving image ("synching")
  48. will be considered an Adaptation for the purpose of this
  49. License.
  50. b. "Collection" means a collection of literary or artistic works,
  51. such as encyclopedias and anthologies, or performances,
  52. phonograms or broadcasts, or other works or subject matter
  53. other than works listed in Section 1(f) below, which, by
  54. reason of the selection and arrangement of their contents,
  55. constitute intellectual creations, in which the Work is
  56. included in its entirety in unmodified form along with one or
  57. more other contributions, each constituting separate and
  58. independent works in themselves, which together are assembled
  59. into a collective whole. A work that constitutes a Collection
  60. will not be considered an Adaptation (as defined above) for
  61. the purposes of this License.
  62. c. "Distribute" means to make available to the public the
  63. original and copies of the Work or Adaptation, as appropriate,
  64. through sale or other transfer of ownership.
  65. d. "Licensor" means the individual, individuals, entity or
  66. entities that offer(s) the Work under the terms of this License.
  67. e. "Original Author" means, in the case of a literary or artistic
  68. work, the individual, individuals, entity or entities who
  69. created the Work or if no individual or entity can be
  70. identified, the publisher; and in addition (i) in the case of
  71. a performance the actors, singers, musicians, dancers, and
  72. other persons who act, sing, deliver, declaim, play in,
  73. interpret or otherwise perform literary or artistic works or
  74. expressions of folklore; (ii) in the case of a phonogram the
  75. producer being the person or legal entity who first fixes the
  76. sounds of a performance or other sounds; and, (iii) in the
  77. case of broadcasts, the organization that transmits the
  78. broadcast.
  79. f. "Work" means the literary and/or artistic work offered under
  80. the terms of this License including without limitation any
  81. production in the literary, scientific and artistic domain,
  82. whatever may be the mode or form of its expression including
  83. digital form, such as a book, pamphlet and other writing; a
  84. lecture, address, sermon or other work of the same nature; a
  85. dramatic or dramatico-musical work; a choreographic work or
  86. entertainment in dumb show; a musical composition with or
  87. without words; a cinematographic work to which are assimilated
  88. works expressed by a process analogous to cinematography; a
  89. work of drawing, painting, architecture, sculpture, engraving
  90. or lithography; a photographic work to which are assimilated
  91. works expressed by a process analogous to photography; a work
  92. of applied art; an illustration, map, plan, sketch or three-
  93. dimensional work relative to geography, topography,
  94. architecture or science; a performance; a broadcast; a
  95. phonogram; a compilation of data to the extent it is protected
  96. as a copyrightable work; or a work performed by a variety or
  97. circus performer to the extent it is not otherwise considered
  98. a literary or artistic work.
  99. g. "You" means an individual or entity exercising rights under
  100. this License who has not previously violated the terms of
  101. this License with respect to the Work, or who has received
  102. express permission from the Licensor to exercise rights under
  103. this License despite a previous violation.
  104. h. "Publicly Perform" means to perform public recitations of the
  105. Work and to communicate to the public those public
  106. recitations, by any means or process, including by wire or
  107. wireless means or public digital performances; to make
  108. available to the public Works in such a way that members of
  109. the public may access these Works from a place and at a place
  110. individually chosen by them; to perform the Work to the public
  111. by any means or process and the communication to the public of
  112. the performances of the Work, including by public digital
  113. performance; to broadcast and rebroadcast the Work by any
  114. means including signs, sounds or images.
  115. i. "Reproduce" means to make copies of the Work by any means
  116. including without limitation by sound or visual recordings and
  117. the right of fixation and reproducing fixations of the Work,
  118. including storage of a protected performance or phonogram in
  119. digital form or other electronic medium.
  120. 2. Fair Dealing Rights. Nothing in this License is intended to
  121. reduce, limit, or restrict any uses free from copyright or rights
  122. arising from limitations or exceptions that are provided for in
  123. connection with the copyright protection under copyright law or
  124. other applicable laws.
  125. 3. License Grant. Subject to the terms and conditions of this
  126. License, Licensor hereby grants You a worldwide, royalty-free,
  127. non-exclusive, perpetual (for the duration of the applicable
  128. copyright) license to exercise the rights in the Work as stated
  129. below:
  130. a. to Reproduce the Work, to incorporate the Work into one or
  131. more Collections, and to Reproduce the Work as incorporated
  132. in the Collections;
  133. b. to create and Reproduce Adaptations provided that any such
  134. Adaptation, including any translation in any medium, takes
  135. reasonable steps to clearly label, demarcate or otherwise
  136. identify that changes were made to the original Work. For
  137. example, a translation could be marked "The original work was
  138. translated from English to Spanish," or a modification could
  139. indicate "The original work has been modified.";
  140. c. to Distribute and Publicly Perform the Work including as
  141. incorporated in Collections; and,
  142. d. to Distribute and Publicly Perform Adaptations.
  143. e. For the avoidance of doubt:
  144. i. Non-waivable Compulsory License Schemes. In those
  145. jurisdictions in which the right to collect royalties
  146. through any statutory or compulsory licensing scheme cannot
  147. be waived, the Licensor reserves the exclusive right to
  148. collect such royalties for any exercise by You of the
  149. rights granted under this License;
  150. ii. Waivable Compulsory License Schemes. In those
  151. jurisdictions in which the right to collect royalties
  152. through any statutory or compulsory licensing scheme can
  153. be waived, the Licensor waives the exclusive right to
  154. collect such royalties for any exercise by You of the
  155. rights granted under this License; and,
  156. iii. Voluntary License Schemes. The Licensor waives the right
  157. to collect royalties, whether individually or, in the
  158. event that the Licensor is a member of a collecting
  159. society that administers voluntary licensing schemes, via
  160. that society, from any exercise by You of the rights
  161. granted under this License.
  162. The above rights may be exercised in all media and formats whether
  163. now known or hereafter devised. The above rights include the right
  164. to make such modifications as are technically necessary to exercise
  165. the rights in other media and formats. Subject to Section 8(f), all
  166. rights not expressly granted by Licensor are hereby reserved.
  167. 4. Restrictions. The license granted in Section 3 above is expressly
  168. made subject to and limited by the following restrictions:
  169. a. You may Distribute or Publicly Perform the Work only under the
  170. terms of this License. You must include a copy of, or the
  171. Uniform Resource Identifier (URI) for, this License with every
  172. copy of the Work You Distribute or Publicly Perform. You may
  173. not offer or impose any terms on the Work that restrict the
  174. terms of this License or the ability of the recipient of the
  175. Work to exercise the rights granted to that recipient under
  176. the terms of the License. You may not sublicense the Work. You
  177. must keep intact all notices that refer to this License and to
  178. the disclaimer of warranties with every copy of the Work You
  179. Distribute or Publicly Perform. When You Distribute or
  180. Publicly Perform the Work, You may not impose any effective
  181. technological measures on the Work that restrict the ability
  182. of a recipient of the Work from You to exercise the rights
  183. granted to that recipient under the terms of the License. This
  184. Section 4(a) applies to the Work as incorporated in a
  185. Collection, but this does not require the Collection apart
  186. from the Work itself to be made subject to the terms of this
  187. License. If You create a Collection, upon notice from any
  188. Licensor You must, to the extent practicable, remove from the
  189. Collection any credit as required by Section 4(b), as
  190. requested. If You create an Adaptation, upon notice from any
  191. Licensor You must, to the extent practicable, remove from the
  192. Adaptation any credit as required by Section 4(b), as requested.
  193. b. If You Distribute, or Publicly Perform the Work or any
  194. Adaptations or Collections, You must, unless a request has
  195. been made pursuant to Section 4(a), keep intact all copyright
  196. notices for the Work and provide, reasonable to the medium or
  197. means You are utilizing: (i) the name of the Original Author
  198. (or pseudonym, if applicable) if supplied, and/or if the
  199. Original Author and/or Licensor designate another party or
  200. parties (e.g., a sponsor institute, publishing entity,
  201. journal) for attribution ("Attribution Parties") in Licensor's
  202. copyright notice, terms of service or by other reasonable
  203. means, the name of such party or parties; (ii) the title of
  204. the Work if supplied; (iii) to the extent reasonably
  205. practicable, the URI, if any, that Licensor specifies to be
  206. associated with the Work, unless such URI does not refer to
  207. the copyright notice or licensing information for the Work;
  208. and (iv), consistent with Section 3(b), in the case of an
  209. Adaptation, a credit identifying the use of the Work in the
  210. Adaptation (e.g., "French translation of the Work by Original
  211. Author," or "Screenplay based on original Work by Original
  212. Author"). The credit required by this Section 4 (b) may be
  213. implemented in any reasonable manner; provided, however, that
  214. in the case of a Adaptation or Collection, at a minimum such
  215. credit will appear, if a credit for all contributing authors
  216. of the Adaptation or Collection appears, then as part of these
  217. credits and in a manner at least as prominent as the credits
  218. for the other contributing authors. For the avoidance of
  219. doubt, You may only use the credit required by this Section
  220. for the purpose of attribution in the manner set out above
  221. and, by exercising Your rights under this License, You may not
  222. implicitly or explicitly assert or imply any connection with,
  223. sponsorship or endorsement by the Original Author, Licensor
  224. and/or Attribution Parties, as appropriate, of You or Your use
  225. of the Work, without the separate, express prior written
  226. permission of the Original Author, Licensor and/or
  227. Attribution Parties.
  228. c. Except as otherwise agreed in writing by the Licensor or as
  229. may be otherwise permitted by applicable law, if You
  230. Reproduce, Distribute or Publicly Perform the Work either by
  231. itself or as part of any Adaptations or Collections, You must
  232. not distort, mutilate, modify or take other derogatory action
  233. in relation to the Work which would be prejudicial to the
  234. Original Author's honor or reputation. Licensor agrees that in
  235. those jurisdictions (e.g. Japan), in which any exercise of the
  236. right granted in Section 3(b) of this License (the right to
  237. make Adaptations) would be deemed to be a distortion,
  238. mutilation, modification or other derogatory action
  239. prejudicial to the Original Author's honor and reputation, the
  240. Licensor will waive or not assert, as appropriate, this
  241. Section, to the fullest extent permitted by the applicable
  242. national law, to enable You to reasonably exercise Your right
  243. under Section 3(b) of this License (right to make Adaptations)
  244. but not otherwise.
  245. 5. Representations, Warranties and Disclaimer
  246. UNLESS OTHERWISE MUTUALLY AGREED TO BY THE PARTIES IN WRITING,
  247. LICENSOR OFFERS THE WORK AS-IS AND MAKES NO REPRESENTATIONS OR
  248. WARRANTIES OF ANY KIND CONCERNING THE WORK, EXPRESS, IMPLIED,
  249. STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF
  250. TITLE, MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE,
  251. NONINFRINGEMENT, OR THE ABSENCE OF LATENT OR OTHER DEFECTS,
  252. ACCURACY, OR THE PRESENCE OF ABSENCE OF ERRORS, WHETHER OR NOT
  253. DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF
  254. IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO YOU.
  255. 6. Limitation on Liability. EXCEPT TO THE EXTENT REQUIRED BY
  256. APPLICABLE LAW, IN NO EVENT WILL LICENSOR BE LIABLE TO YOU ON ANY
  257. LEGAL THEORY FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE
  258. OR EXEMPLARY DAMAGES ARISING OUT OF THIS LICENSE OR THE USE OF
  259. THE WORK, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY
  260. OF SUCH DAMAGES.
  261. 7. Termination
  262. a. This License and the rights granted hereunder will terminate
  263. automatically upon any breach by You of the terms of this
  264. License. Individuals or entities who have received Adaptations
  265. or Collections from You under this License, however, will not
  266. have their licenses terminated provided such individuals or
  267. entities remain in full compliance with those licenses.
  268. Sections 1, 2, 5, 6, 7, and 8 will survive any termination of
  269. this License.
  270. b. Subject to the above terms and conditions, the license granted
  271. here is perpetual (for the duration of the applicable
  272. copyright in the Work). Notwithstanding the above, Licensor
  273. reserves the right to release the Work under different license
  274. terms or to stop distributing the Work at any time; provided,
  275. however that any such election will not serve to withdraw this
  276. License (or any other license that has been, or is required to
  277. be, granted under the terms of this License), and this License
  278. will continue in full force and effect unless terminated as
  279. stated above.
  280. 8. Miscellaneous
  281. a. Each time You Distribute or Publicly Perform the Work or a
  282. Collection, the Licensor offers to the recipient a license to
  283. the Work on the same terms and conditions as the license
  284. granted to You under this License.
  285. b. Each time You Distribute or Publicly Perform an Adaptation,
  286. Licensor offers to the recipient a license to the original
  287. Work on the same terms and conditions as the license granted
  288. to You under this License.
  289. c. If any provision of this License is invalid or unenforceable
  290. under applicable law, it shall not affect the validity or
  291. enforceability of the remainder of the terms of this License,
  292. and without further action by the parties to this agreement,
  293. such provision shall be reformed to the minimum extent
  294. necessary to make such provision valid and enforceable.
  295. d. No term or provision of this License shall be deemed waived
  296. and no breach consented to unless such waiver or consent shall
  297. be in writing and signed by the party to be charged with such
  298. waiver or consent.
  299. e. This License constitutes the entire agreement between the
  300. parties with respect to the Work licensed here. There are no
  301. understandings, agreements or representations with respect to
  302. the Work not specified here. Licensor shall not be bound by
  303. any additional provisions that may appear in any communication
  304. from You. This License may not be modified without the mutual
  305. written agreement of the Licensor and You.
  306. f. The rights granted under, and the subject matter referenced,
  307. in this License were drafted utilizing the terminology of the
  308. Berne Convention for the Protection of Literary and Artistic
  309. Works (as amended on September 28, 1979), the Rome Convention
  310. of 1961, the WIPO Copyright Treaty of 1996, the WIPO
  311. Performances and Phonograms Treaty of 1996 and the Universal
  312. Copyright Convention (as revised on July 24, 1971). These
  313. rights and subject matter take effect in the relevant
  314. jurisdiction in which the License terms are sought to be
  315. enforced according to the corresponding provisions of the
  316. implementation of those treaty provisions in the applicable
  317. national law. If the standard suite of rights granted under
  318. applicable copyright law includes additional rights not
  319. granted under this License, such additional rights are deemed
  320. to be included in the License; this License is not intended to
  321. restrict the license of any rights under applicable law.
  322. Creative Commons is not a party to this License, and makes no
  323. warranty whatsoever in connection with the Work. Creative Commons
  324. will not be liable to You or any party on any legal theory for any
  325. damages whatsoever, including without limitation any general,
  326. special, incidental or consequential damages arising in connection
  327. to this license. Notwithstanding the foregoing two (2) sentences,
  328. if Creative Commons has expressly identified itself as the Licensor
  329. hereunder, it shall have all rights and obligations of Licensor.
  330. Except for the limited purpose of indicating to the public that the
  331. Work is licensed under the CCPL, Creative Commons does not authorize
  332. the use by either party of the trademark "Creative Commons" or any
  333. related trademark or logo of Creative Commons without the prior
  334. written consent of Creative Commons. Any permitted use will be in
  335. compliance with Creative Commons' then-current trademark usage
  336. guidelines, as may be published on its website or otherwise made
  337. available upon request from time to time. For the avoidance of
  338. doubt, this trademark restriction does not form part of this
  339. License.
